Terms of Service
1. Acceptance of terms
By accessing or using the website at stockandsauce.ca (the “Site”) or placing an order, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.
2. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable federal, provincial, or local laws or regulations, or to transmit unsolicited commercial communications.
3. Products, pricing & orders
We make every effort to display our products and prices accurately. Prices shown online are our online prices and may differ from in-market pricing. The total in your order summary, including any delivery charge and any GST, is the total for your order. All food products are subject to availability and may be seasonal. We reserve the right to limit quantities, correct errors, and refuse or cancel any order. Because our products are perishable, please contact us promptly with any concern about an order so we can make it right.
Not everything on the Site can be ordered online. Our salads are prepared fresh for each market and our seasonal items are only made at certain times of year. Those products are listed so you can see what we make, but they are not available for online ordering or delivery; you will find them at our market stalls.
4. Payment, delivery & pickup
The checkout page tells you, before you place your order, which of these two ways applies:
- Card at checkout. Where card payment is offered, you pay the total in your order summary in the secure card form of our payment processor, Stripe, which appears on our checkout page. You tick a box there to accept these Terms. We then email you to confirm the day we will deliver your order or have it ready for pickup.
- Pay on confirmation. Where card payment is not offered, your order is sent to us as a request, and we contact you to confirm the total, how to pay, and the day we will deliver it or have it ready for pickup.
We deliver within Calgary, or you can pick up at either Calgary Farmers’ Market location. Delivery is free on orders of $50 or more and $15 for orders under $50; market pickup is free. GST. Most of our food carries no GST. Any GST that does apply to your order is shown as a separate line in your order summary before you place it.
5. Cancellations & refunds
You may cancel an order at any time before we pack it, at no cost and for any reason. Reply to the confirmation email we send you, or contact us using the details in section 13. We will tell you in that email when we intend to pack your order. If you paid by card, a cancelled order is refunded in full to the card you paid with.
Once an order has been packed it cannot be cancelled, because our food is perishable and cannot go back into stock once it has been packed for you. If anything arrives damaged, incorrect, or not to the standard you expected, contact us within 48 hours of delivery or pickup and we will replace it or refund it. Refunds are issued by the same method used for payment. Nothing in this section limits any right to cancel that you have under Alberta law.
6. Intellectual property
The Site and its original content, features, recipes, branding, and functionality are owned by Stock & Sauce and are protected by Canadian copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Disclaimer of warranties
The Site and its content are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Product descriptions are provided in good faith; if you have a food allergy or sensitivity, contact us before ordering.
8. Limitation of liability
To the fullest extent permitted by applicable law, Stock & Sauce and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the order giving rise to the claim, or $100 CAD, whichever is greater.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for personal injury caused by our negligence, and nothing in these Terms takes away any right you have under Alberta’s consumer protection laws.
9. Indemnification
You agree to indemnify, defend, and hold harmless Stock & Sauce and its owners, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party rights.
10. Third-party links
The Site may contain links to third-party websites, provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
11. Governing law & venue
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Calgary, Alberta.
12. Changes to these terms
We reserve the right to modify these Terms at any time. Changes take effect upon posting and apply to orders placed after that; an order we have already confirmed stays under the Terms that applied when you placed it. Your continued use of the Site after changes constitutes acceptance of the new Terms. We will update the “Last updated” date above when changes are made.
